Agreement to Use
By downloading, installing, or using the SBD Loyalty application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("User") and Balaji Diamonds Pvt Ltd ("Company," "we," "us," or "our"), registered and operating in Kathmandu, Nepal.
If you do not agree with any part of these Terms, you must not use the App. Continued use of the App following any updates to these Terms constitutes your acceptance of the revised Terms.
Who May Use This App
The SBD Loyalty App is intended for use by individuals who are 18 years of age or older. By creating an account, you confirm that you are at least 18 years old and are legally capable of entering into a binding agreement.
If you are using the App on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.
Account Registration & Responsibility
To access certain features of the App, including placing orders and earning loyalty points, you are required to create an account by providing accurate personal information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
- You may delete your account at any time through the App's account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
Earning & Redemption
The SBD Loyalty programme allows users to earn points on qualifying purchases made through the App.
- Points are credited to your account upon successful confirmation of your order.
- Points have no cash value and cannot be exchanged for currency.
- Points are non-transferable and linked exclusively to your account.
- We reserve the right to modify, suspend, or discontinue the loyalty programme at any time with reasonable notice.
- Any fraudulent or manipulative activity related to the loyalty programme will result in immediate account termination and forfeiture of all points.
- Accumulated points may expire if your account is inactive for an extended period, as notified separately.
Placing Orders
Orders placed through the SBD Loyalty App are requests to purchase jewellery from Balaji Diamonds Pvt Ltd. All orders are subject to product availability and confirmation by our team.
Manual Payment: SBD Loyalty does not integrate any online payment gateway. All payments are to be made manually and directly to Balaji Diamonds Pvt Ltd at our physical store or through a channel agreed upon with our team. No financial transaction data is processed within the App.
- Order placement through the App does not constitute a guarantee of availability or pricing until confirmed by our team.
- Our team will contact you to confirm order details and arrange payment.
- We reserve the right to decline or cancel orders for any reason, including product unavailability or pricing errors.
Ownership of Content
All content within the SBD Loyalty App, including but not limited to product videos, photographs, descriptions, logos, graphics, text, and the App design itself, is the exclusive property of Balaji Diamonds Pvt Ltd and is protected under applicable copyright and intellectual property laws.
- All product videos in the catalogue are original creations produced exclusively by SBD Loyalty and are fully copyright-protected.
- You may not reproduce, distribute, modify, publicly display, or create derivative works from any content in the App without our prior written consent.
- Unauthorised use of our intellectual property may result in legal action.
In-App Communication
The SBD Loyalty App provides communication features including chat, voice calls, and video calls with our in-store team. These features are provided solely to help you view and inquire about products before purchasing.
- You must use communication features respectfully and lawfully.
- Any abusive, threatening, or inappropriate communication will result in account suspension.
- Push notifications are sent for order updates and relevant information. You may manage notification preferences in your device settings.
- By enabling notifications, you consent to receive order-related alerts from the App.
Disclaimer
The SBD Loyalty App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's availability, accuracy, or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Balaji Diamonds Pvt Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data or loyalty points due to technical issues beyond our control.
Jurisdiction
These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
